CEN Biotech Wants Review Of Rejection

CEN Biotech is requesting a federal court issue a judicial review of Health Canada's intent to reject the company's application for a medical marijuana license.

The Lakeshore company filed the notice with the federal court on February 20. Health Canada has 10 days from receiving the court documents to file a response. "Given that the matter is now before the courts, Health Canada cannot offer any further comment," a spokesperson tells BlackburnNews.com in an email.

In the court documents CEN Biotech alleges Health Canada's license refusal is "unlawful or unreasonable or both." Back on December 13, 2013, CEN Biotech also claims Health Canada officials "committed" to issuing a license.

CEN Biotech says "all reasonable attempts" to receive a license have been made.

On December 13, Health Canada sent the company a letter of intent to reject its license, but the reasons were never made public. Health Canada officials say CEN Biotech has until March 5 to appeal the decision before it becomes final.
