Kingsville Company Fined In Worker's Death

A Kingsville power company has been found guilty and fined after one of its employees died while working on a solar farm construction project.

Enerquest Services Inc. has been fined $110,000. A judge ruled the company failed to establish and implement written procedures to ensure workers were adequately protected from electrical shock.

On December 13, 2013 one worker was installing a door in a high voltage area of the building when he was electrocuted by a transformer. A coworker found him and he was taken to hospital where he was pronounced dead.

The two were working on a solar project in Sunderland, north of Oshawa near Lake Simcoe.

During the two days they were there, the judge found both employees worked on or near exposed parts of equipment that were energized. The judge ruled this power source was not disconnected, locked out of service or tagged in accordance with provincial regulations.

The court also imposed a 25% victim surcharge, which will be credited to a special government fund to assist victims of crime. The ruling came down in a Whitby court earlier this week.
