City police say Pat Cayen was held for a bail hearing and released the following day.
The 56-year-old Cayen was initially charged in November 2012.
His employment with the Sarnia fire department was terminated in January 2013.
SPS Board Chair Kelly Ash said the decision followed discussions with Acting Chief Mike Federico and aligns with practices at other police services.
