A Sarnia dentist has been found guilty of assault charges in connection with a stabbing nearly three years ago.
Superior Court Justice Russell Raikes delivered his guilty verdict to Kevin Fareed Bacchus in the Sarina courthouse Thursday morning.
Bacchus, 51, was arrested and charged with aggravated assault and assault with a weapon in October of 2019 following an alleged altercation that left a 37-year-old man with serious injuries.
In his decision, Raikes detailed how the defendant sprayed the man with bear spray, stabbed and cut the man and embedded the tip of a knife in the victim's head.
Raikes said even if there was a struggle between the two parties, who had a history of violence and bad blood, he found that Bacchus was the aggressor in this circumstance and that his response was unreasonable.
Raikes was satisfied beyond a reasonable doubt that the crown had proven that one or more of the acquired elements for self-defence was not present, leading to the guilty verdict.
Raikes did not enter the convictions because of an 11(b) application that has been brought forward. The section of the charter states that “any person charged with an offence has the right to be tried within a reasonable time”.
A sentencing date has not been set.
