Brush Facing First Degree Murder Charge

Matthew Brush will stand trial for first degree murder for the death of Cassandra Kaake.

A judge made the decision after a pre-trial hearing, the details of which are under a publication ban.

Jeff Durham, the father of Kaake's unborn child says it's a difficult day for him.

"It's good that it's going as first degree murder but it's difficult to find solace cause I still feel the charges don't represent Cassie's rights as a woman," says Durham.

Kaake was killed while seven months pregnant in December 2014, however the court does not recognize the unborn child, Molly, when considering charges.

Brush is also facing charges of arson with disregard for human life and indecent interference with a dead body.

A trial date will be set in Superior Court on April 8.
