Worker's fatal fall leads to fine against Delhi company

A small Delhi construction company has been fined $117,500 after one of its workers was killed at a jobsite in Aylmer two years ago.

VanHeughten Contractors Inc. had four employees installing wooden roof trusses on top of framed walls as part of a construction project at 51235 Chalet Line in Aylmer. As one of the workers was standing on a two-by-four inch wood strapping, nailing wood with a cordless framing nailer on March 4, 2022, the strap broke. The worker fell 5.08 metres from the roof and was hit by the nail gun.

The worker died from their injuries.

The Ministry of Labour found the company had no guardrails installed at the job site and none of the workers were wearing any prescribed fall protection equipment or protective headwear.

The company pleaded guilty in provincial offences court in St. Thomas in March of this year to the offence of failing to ensure that the worker was protected by a means of fall protection, contrary to the Occupational Health and Safety Act. The company was fined $85,000 and its director was fined $32,500.

A 25 per cent victim fine surcharge as required by the Provincial Offences Act was also imposed.

Two men arrested in Tashmoo Ave. standoff

Sarnia police said the investigation began on May 29 after the victim was allegedly attacked by acquaintances at a residence near Tashmoo Avenue and Christopher Drive at Aamjiwnaang First Nation.
