Bigamy Trial Awaiting Attorney General's Input

A Chatham bigamy trial has been put on hold as the provincial attorney general's office considers intervening in the case.

Timothy Mielczarek's case was put over on April 16 when Justice Thomas Carey questioned whether or not bigamy law was constitutional in the modern world. This after hearing from Mielczarek's two ex-wives and a municipal clerk.

Both the federal and provincial attorney general's offices have the right to intervene when a court questions constitutional law. On Monday, Justice Thomas Carey told the Crown and defence the provincial attorney general is still reviewing transcripts of the case.

The Federal Crown's office has already stated via email it won't be getting involved.

Mielczarek, 45, was arrested back in 2013 following a domestic-related incident, and charged with bigamy. He'll be back at the Chatham courthouse May 24, where lawyers hope to get an update from the Provincial Crown, and where they stand on the case.

Two men arrested in Tashmoo Ave. standoff

Sarnia police said the investigation began on May 29 after the victim was allegedly attacked by acquaintances at a residence near Tashmoo Avenue and Christopher Drive at Aamjiwnaang First Nation.
