A Sarnia man accused of murdering a Chatham man could be released on bail later this week.
Kyle Samko, 26, is charged with first degree murder in the death of Manny da Silva, 35, of Chatham.
Superior Court Judge Bruce Thomas is weighing submissions and a bail plan made by Chatham Assistant Crown James Boonstra and Samko's defence lawyer Luigi Perzia at a bail review on Tuesday and will return with a decision on bail for Samko on Thursday afternoon.
Samko's mother and step father have come forward as sureties for their son with $10,000 in bail. The bail plan includes a GPS device and ankle monitor.
The Crown said the risk is too high and wants bail for Samko denied. However, the defence said Samko could be supervised in the community.
According to published reports, Samko was convicted in Sarnia in October on charges, including drug trafficking. He admitted to the court at the time that he has a drug problem.
Chatham-Kent police reported in June that an altercation took place on George Street near Park Avenue in Chatham involving several men who knew each other. Police said the victim was seriously hurt and succumbed to his injuries at the Chatham-Kent Health Alliance.
There is a publication ban preventing any evidence and any further information from being published to protect the fairness and integrity of the case.
