Sarnia's development charge bylaw appealed

Sarnia's recently adopted development charge bylaw has been appealed.

The document was passed on January 15 after the city was left in limbo for the first two weeks of 2024.

In a report to council at the end of March, Planning and Development Services Manager Eric Hyatt said the city received an appeal on February 28, one day before the February 29 deadline to file an appeal.

Hyatt said there is no impact to the development charge bylaw as a result of the appeal at this time.

"Development charges will still be calculated and collected in accordance with the adopted bylaw," he said.

Any person or organization could have appealed the bylaw within 40 days of it being passed.

Hyatt said the Ontario Land Tribunal [OLT] will hold a hearing as a result.

"After the hearing the tribunal may dismiss the appeal, order the council of the municipality to repeal or amend the bylaw, or repeal or amend the bylaw in such manner as the tribunal may determine," Hyatt said.

He said staff have forwarded the required information to the OLT and are awaiting direction.
